MINUTES OF THE SPECIAL

MEETING OF THE

LAKESITE CITY ZONING BOARD OF APPEALS

FEBRUARY 19, 2008

Chairman Mullin called with meeting to order at 8:35p.m. Roll was called with Chairman Mullin, Vice Chairman Wilkerson, John McPherson, City Manager Edwards and City Attorney Elliott present. Phil Burkett was absent.

John McPherson made a motion to approve the minutes of the last Zoning Board of Appeals meeting held on November 29, 2005. Ken Wilkerson seconded the motion. All members voted aye and motion carried.

Those in attendance were Tammy Brewton, Jackie Shelby, Vern Thomas, Curt Blair, Hilary Lyons and David Howell.

The business to come before the Board was the application for a variance by Tammy Brewton, 2323 Buffalo Lane requesting a variance to the Lakesite Zoning Ordinance requiring a 25 foot rear lot line set back. She wishes to build a detached garage but, because of the shape and size of her lot, she needs to put it at the location 5 feet from the rear lot line.

Jackie Shelby, who lives behind her, said the actual measurement would be 5.5 feet and 2.5 feet from the corners of the garage to his lot line as his fence is 6 inches inside his lot line. Also there would be an overhang as the eaves on the roof would extend further. He further said the view from his lot to the water would be blocked. John McPherson said it would be hard to keep the area between the garage and fence cleaned if it was that close. Chairman Mullin asked if the garage could be moved closer to the home. He felt the proposed location was more of a convenience than a hardship. She was asked if the garage could face Buffalo Lane rather that her home.

Ken Wilkerson made a motion to deny the request for the variance. John McPherson seconded the motion. All members voted aye and request was denied.

Ken Wilkerson made a motion to adjourn. Chairman Mullin adjourned the meeting at 8:50 p.m.
