MINUTES OF THE REGULAR STATED

MEETING OF THE

LAKESITE CITY COMMISSION

MAY 15, 2007





Mayor Mullin called the meeting to order at 7:07 p.m. Vice Mayor Wilkerson gave the Invocation. Commissioner Allis led the Pledge of Allegiance. Roll was called with Mayor Mullin, Vice Mayor Wilkerson, Commissioner Allis, Commissioner Burkett, Commissioner McPherson, City Manager Edwards and City Attorney Elliott present. Commissioner Allis made a motion to accept the minutes of the Agenda Meeting and Regular Meeting held April 17, 2007. Vice Mayor Wilkerson seconded the motion. All Commissioners voted aye and motion carried to approve both sets of minutes.


Ron Rice, Hamilton County Sheriffs Department, gave a report on March and April calls to the City. Assistant Chief Shadwick, Dallas Bay Volunteer Fire Department, reported five calls to the City in April.


Leroy Beasley said there are still go carts, golf carts, etc. on the streets. He asked what the schedule is for doing the center stripe on Chimney Hills streets. Curt Blair is coordinating the project. Mr. Beasley asked about speed humps on Chimney Hills Drive and Mayor Mullin said we will place them on Lakesite Drive first and see if they are effective. If so Chimney Hills Drive and Lyons Lane will be looked at for placement of speed humps. Commissioner Burkett said he would like written approval from the Homeowners Association in Chimney Hills to place speed humps there.


Tim Brown would like to see a zoning change on his property to M1. Attorney Elliott said zoning changes must go through the Regional Planning Agency. City Manager Edwards asked the Commissioners to pass a resolution concerning zoning. Commissioner Burkett made a motion to have the RPA review our zoning based on our land use plan. Vice Mayor Wilkerson seconded the motion. All Commissioners voted aye and motion carried.


Commissioner Allis, Parks & Recreation, reported a study was being done to improve Little Chickey. Afer the Commissioners reviewed the recommendations, it was suggested the City do more surveying on the pond to see if the leak can be located before proceeding further. Commissioner Allis made a motion to have Qore Property Sciences do an engineering consultation and test the pond for leak sites at a cost of $7500. Vice Mayor Wilkerson seconded the motion. Mayor Mullin, Vice Mayor Wilkerson, Commissioner Allis and Commissioner Burkett voted aye and Commissioner McPherson voted no. Motion passed.


Commissioner Burkett, Public Works, reported the contract has been signed for our road maintenance plan.


Vice Mayor Wilkerson, Public Safety, said the Sheriffs Department will increase patrol and saturate the area one or two days a month. This should help with speeders and after hours noise and cars at the park area. He also reported attending a County pandemic meeting which concerned a detailed plan about human-to-human disease transmission disasters. Vice Mayor made a motion to have the City donate $500 towards the EMS awards program as we have done in the past. Commissioner Burkett seconded the motion. All Commissioners voted aye and motion carried.


Attorney Elliott said he will speak with judges at Sessions Court concerning the Sheriffs Department enforcing City ordinances and handling violations in Sessions Court.


Commissioner Allis made a motion to pass Ordinance 173, to amend the Municipal Code Title 8, Alcoholic Beverages, Section 108, Fees. Vice Mayor Wilkerson seconded the motion. Roll call vote: All Commissioners voted aye and Ordinance 173 passed on first reading.


Vice Mayor Wilkerson made a motion to pass Ordinance 174, amending the budget for the fiscal year 2006-2007. Commissioner McPherson seconded the motion. Roll call vote: All Commissioners voted aye and Ordinance 174 passed on first reading.


Commissioner McPherson made a motion to pass Ordinance 175, to make and fix the annual appropriation of the several departments of the City for the fiscal year 2007-2008 and adopting the City budget by reference. Commissioner Alllis seconded the motion. Roll call vote: All Commissioners voted aye and Ordinance 175 passed on first reading.


Commissioner McPherson made a motion to pass Ordinance 176, to provide for the general revenue for the fiscal year 2007-2008 (setting the tax rate at $0.290 per $100 valuation). Commissioner Burkett seconded the motion. Roll call vote: All Commissioners voted aye and Ordinance 176 passed on first reading.


Resolution 74, authorizing the Mayor to make application to TVA for long term land rights. Commissioner McPherson had concerns about the mention, in the resolution, to not collect any fees. He prefers that the reference be removed in case there is a need for fees in the future. Commissioner Burkett made a motion to pass Resolution 74 on the condition that the City tries to make the best effort to get the mention of collecting no fees be removed. If this is not possible, then proceed. Vice Mayor Wilkerson seconded the motion. All Commissioners voted aye and motion carried to pass Resolution 74.


Commissioner Burkett made a motion to review the residential PUD plans presented by Jaggers Bay LLC. He has concerns about lot sizes and lack of common use area. It was suggested the City notify Jaggers Bay, in writing, of the concerns before they proceed further. Commissioner McPherson amended the motion to have included plans on the rest of the marina project which was not addressed in these plans. Commissioner Allis seconded the motion. All Commissioners voted aye and motion passed.


Mr. Beavers said hydrants have been installed (one on Hale Road and two on Daisy Dallas). A letter will be sent to residents to contact their insurance company with this information.


Commissioner Allis thanked the Commissioners and residents for their support for park and recreation plans. He said it should increase the standard of living and provide a better family life style.


Vice Mayor Wilkerson made a motion to adjourn. Mayor Mullin adjourned the meeting at 8:10 p.m.
