MINUTES OF THE REGULAR STATEDMEETING OF THELAKESITE CITY COMMISSION   OCTOBER 17, 2006  

Mayor Mullin called the meeting to order at 7:10 p.m. Vice Mayor Wilkerson gave the Invocation. Commissioner Allis led the Pledge of Allegiance. Roll was called with Mayor Mullin, Vice Mayor Wilkerson, Commissioner Allis, Commissioner Burkett, Commissioner McPherson, City Manager Edwards and City Attorney Elliott present.

Commissioner Burkett made a motion to accept the minutes of the September 19, 2006 agenda meeting. Commissioner Allis seconded the motion. All Commissioners voted aye and motion carried.

Vice Mayor Wilkerson made a motion to accept the minutes of the September 19, 2006 regular meeting. Commissioner Burkett seconded the motion. All Commissioners voted aye and motion carried. 

Officer Rice gave the Commissioners the September Sheriff’s Department report. Kevin Shadwick, Dallas Bay Volunteer Fire Department, gave the report for August 2006 (three calls) and September 2006 (six calls). 

City Manager Edwards reported meeting with two TDOT engineers October 5, 2006 to discuss the problem curve on Lakesite Drive. Speeders have driven into the yard at 2229 Lakesite on three occasions, destroying property. They offered three options: changing the road elevation, extensive guardrail installation or speed humps with signage. City Manager Edwards recommended the speed humps option and was given approval by the Commission to proceed.

Commissioner Burkett recommended also putting speed humps on Chimney Hills Drive, in the area where cars have gone into a yard two or three times. Curt Blair will oversee the project. 

City Manager Edwards said Ordinance 171, Purchasing Ordinance, will be ready for the November meeting. 

Commissioner Burkett said Qore Property Sciences had received bids for the Glengerrie paving project and they were $11,000 lower than estimated. The project should get underway soon. He will also ask Qore to get quotes on preventative maintenance measures and set priorities. 

Commissioner McPherson said the budget is fine at this time. Revenues will come in at certain times of the year and City Manager Edwards had done a good job keeping expenditures in line. 

Vice Mayor Wilkerson said the no parking in the street signs were placed on Glengerrie Drive as provided by Ordinance. He said that he and the Mayor will meet with new Sheriff, Billy Long, soon. He asked to have two Sheriff’s Department cars, if possible, parole from 7 p.m. to 1 a.m. on Halloween night.  

Vice Mayor Wilkerson made a motion to approve Ordinance 167, amending the Lakesite Municipal Code Title 13, Chapter 2, to modify the Property Maintenance Code. Attorney Elliott explained, during the public hearing, that this will make the general Property Code fit the City’s needs. Commissioner Burkett seconded the motion. All Commissioners voted aye during roll call vote and Ordinance 167 passed on second and final reading. 

Commissioner Allis made a motion to approve Ordinance 168, amending the Lakesite Municipal Code Title 13, Chapter 1, to modify Section 13-104 pertaining to weeds and adding a section to address overgrown and dirty lots. Vice Mayor Wilkerson seconded the motion. During the public hearing, Attorney Elliott said this will provide for the clean up, at the owner’s expense, if they do not comply with cleaning up weeds and dirty lots. Vice Mayor Wilkerson seconded the motion. Roll call vote: all Commissioners voted aye and Ordinance 168 passed on second and final reading.

 Vice Mayor Wilkerson made a motion to pass Ordinance 169, amending the Lakesite Municipal Code Title 13, adding a chapter addressing slum clearance and amending Title 12 to delete sections. Attorney Elliott explained, during the public hearing, that this allows the City to demolish structures over 50% deteriorated if the owner will not comply and to assess the cost to the owner. Commissioner Allis seconded the motion. Roll call vote: all Commissioners voted aye and Ordinance 169 passed on second and final reading. 

Commissioner Burkett made a motion to pass Ordinance 170, amending the Lakesite Municipal Code Title 13, adding a chapter to address junked motor vehicles and to amend Title 15, Chapter 7, to delete provisions addressing abandoned motor vehicles. During the public hearing, Attorney Elliott explained that this will tighten up our policy, bring all provisions into one ordinance and provides definitions. The vehicle can be anywhere on  public or private property. It must be operative and expired tags may put it in a category to be checked as to being operative. Tim Brown asked if this applied to equipment used for business. Mr. Beavers asked about using an old bus for storage. It is out of sight. Commissioner McPherson seconded the motion. Roll call vote: all Commissioners voted aye and Ordinance 170 passed on second and final reading. 

Commissioner McPherson proposed having CTI do a study on sewers for the benefit of the City in the future. Vice Mayor Wilkerson moved to authorize up to $20,000 for a study by CTI for sewers. Commissioner Allis seconded the motion. All Commissioners voted aye and motion carried. 

Vice Mayor Wilkerson made a motion to adjourn. Mayor Mullin adjourned the meeting at 7:40 p.m.
