October 16, 2007 Agenda Minutes


Mayor Mullin called the meeting to order at 5:25 p.m. In attendance were Mayor Mullin, Vice Mayor Wilkerson, Commissioner McPherson, Attorney Elliott, Codes Officer Jenno, Intern Hilary Lyons, RPA representative Yuen Lee, Maintenance Dave Tate, and Vern Thomas. Absent were Commissioner Allis, Commissioner Burkett and City Manager Edwards.


Mayor Mullin reported stucco work on City Hall was completed. Dave Tate is painting the handrails. He said there is no word on compensation from the original sto contractor.


Mayor Mullin said Hilary Lyons was working on possible business contacts for smaller tracts of available properties.


Mayor Mullin said City Manager Edwards had checked on breakaway posts for a City entrance sign. He will get a price estimate and the Commissioners can decide if they want a sign placed temporarily on the State right-of-way and then possibly a more permanent sign later.


Mayor Mullin said the Boddy’s and Ms. Kirby were okay with the pond survey. The City offered Ms. Donilon to shift ten feet of City property to allow the corner of her garage to be located on her lot. She would like thirty feet to allow her fence to be included. Attorney Elliott suggested a letter giving her thirty days to reply to the ten foot shift adjustment and if she does not reply, the City will proceed. Commissioner McPherson said he would like her to move her fence off of City property.


Mayor Mullin said he was awaiting GPS system information and topographical maps on the TVA park land off of Hixson Pike. He will ask Marty Beach and Curt Blair to look over the area to see what can be done as far as roads, access, clearing, etc. He said he and Hilary Lyons will tour other parks, such as one in Rhea County, for ideas. The TVA park has about fifty acres but not all of it will be developed.


Mayor Mullin said the Total Storage facility is progressing.


Mayor Mullin said, concerning commercial properties, that Mr. Floyd is not interested in selling his property now and Mr. Reeves would evidently like more money for his property.


Mayor Mullin reported the Rails to Trails group is looking into non-matching grants to do a study.


Mayor Mullin said a draft resolution will be ready for the November meeting concerning fair housing grants. He said grants are now available for homes on main roads for low income owners. He said the elderly population is growing, but the funds are decreasing each year.


Mayor Mullin said there will be an open meeting Thursday, October 23, 2007 at 11:00 a.m. concerning the Appalachian corridor from Cleveland to the coast. He said Southeast Tennessee needs a more direct connection with the East Coast for global commerce.


Mayor Mullin reported the need to get the $95,000 CD out of a Georgia depository getting the face value and interest. (Postscript: This has been done.)


Mayor Mullin reports no information on a restroom in the park. He has Soddy Daisy drawings to review and will visit their facilities.


Mayor Mullin said the Commission may wish to be thinking of repairs to the marina boat ramp. Work will be done to see if it is a part of the old Hixson Pike Road or where the ownership lies. Vern Thomas agreed to check into the ownership issue.


Mayor Mullin said “No Shoulder Signs” have been ordered for McConnell School Road.


Mayor Mullin said he and Curt Blair had met with Dallas Bay Baptist Church concerning work they were doing along Daisy Dallas Road and into their property. Curt is following up on the Church Project.


There will be a meeting with Walden’s road and drainage contracter, Commissioner Burkett, City Manager Edwards, Curt Blair, Tim and Dan Brown, and Mrs. Brock on Tuesday, October 23rd concerning drainage on Daisy Dallas Road.


Vice Mayor Wilkerson reported lining up two officers to patrol Halloween from 8pm until 1am at $25 an hour.


Vice Mayor Wilkerson said the saturation of officers is still scheduled and could be around Halloween.


Vice Mayor Wilkerson said he had checked with Walden about citation books for the Sheriffs Department officers. They did not have a separate book. Larry Jenno got citation information from MTAS. Attorney Elliott will look at it. He suggests 8 or 10 most common violations be listed and add a line for others.


Commissioner McPherson said a sewage treatment plant was being considered in the Highway 58 area as a big development was proposed. This would be cheaper than pumping to Moccasin Bend. He said Meigs County may join the WWTA. A possible line could be placed under the Hiawassee River.


Commissioner McPherson said Hamilton County Storm Water Agency will take over January 1, 2008; permits will be obtained from them in the future.


Larry Jenno said the Hale Road equipment storage area looks better. The Daisy Dallas Road area cleanup is slow.


Mr. Jenno said the Welch’s and Hargis’s have moved junk cars. He said he would have an understanding with Mr. Welch about rotating junk cars. He cannot start over the 60 day warning once the notice is given about any car. Attorney Elliott said the warning period applies to the property, not the car.


Attorney Elliott said the City is not involved in 911 funding as we contract with the Hamilton County Sheriffs Department.


Yuen Lee handed out information on PUD for our Zoning Ordinance. She would like the Commissioners input before the end of October. Items to consider are:

Define the number of units such as 3 to 6 or 4 to 8.

Section .02 (a), manufactured homes are ok, mobile homes are not.

Section .03, height and area regulations are ok.

Section .04, off-street parking regulations are ok.

Section .05, general provisions-lot must be recorded.

Section .06,(b) and (d) are needed.

Section .06 (f) Commissioner McPherson wants-must be on sewer only-utilizing existing sewers.

   No need for approval as stated.

Section .06 (e) Storm Water approval after January 1, 2008.

Section .07 no minimum lot size can create a high density situation with townhouses packed in.

  There would be no limit. Need to know the number of attached units we want.

Section .08 open space requirements ok. Is grade slope of 15% ok? What is non-build-able?

Section .08 (b) need to define natural features.

Section .09 recommend tree list for landscaping but don’t put it in the ordinance as it would be too long.

Section .10 do in phases but look at the whole picture- address staging.

Section .11 changes and modifications ok.

Section .12 application procedure-get Curt Blair’s input; condition of plat.


Mayor Mullins adjourned the meeting at 6:55 p.m. .
